First of all the mediator must do pre-mediation preparation. That is where you establish the MEDIATOR’S TRUST-FACTOR. “MTF” You must gain trust before the mediation. At the mediation, ALWAYS walk into the session with a SMILE and a “I will settle this case attitude”
You have to keep telling yourself this as a mediator…over and over… if you give up on yourself, you give up on the parties and outcome of settlement is out of touch. Keep the positive energy flowing in the room. Keep control of the energy all the time. Keep smiling!

Under the heading “other” would be;

Low level negotiational skills of each party and lawyers with a emphasis on debating,point scoring,intransigence and rights based strategies;

Ditto for the mediator especially those with legal/judicial mind set;

Psychological delusion of the above parties that they are competent negotiators and conflict resolvers.
