Mediation is often about changing behavior. The process of litigation however, is not typically a fun process. But maybe there is a way to have some fun in the process, and in doing so, we might be able to change behavior.
There was an interesting experiment in Sweden. Have a look and see.
In this study, by injecting some fun into the process of climbing stairs, they have been able to modify behavior.
How could we inject fun into mediation that could change behavior?
I’ll start the answer by saying that not all of the mediation process has to be serious about a serious issue. Injecting humor into the process — where appropriate — can sometimes lighten the mood in a mediation and help people become ready for change.
How else can you think to inject fun into a mediation?

I always resort to some kid’s type candy when the going gets tough. How about some M&M’s out of a coffee cup at 3 PM? I also give a name to the negotiation when it’s mirroring “game theory”. Sometimes I’ll say, “Oh, this could be fun: What do you expect them to do if you do X?”

I agree. I try to create little games similar to your’s where I say, you guys tell me what you think the offer is from them. and if there is more than one attorney, or client, they might even play an over under process.
